Regulations for renting and reserving apartments

§1
General provisions

  1. These Regulations set forth the terms and conditions for booking and renting apartments offered on the website: www.marinajastarnia.pl Making a reservation is tantamount to knowing and accepting the provisions of these Regulations.
  2. Making a reservation shall at the same time constitute the conclusion of an apartment lease agreement between PortJastar Spółka z ograniczoną odpowiedzialnością Spółka Komandytowa (hereinafter referred to as “PortJastar”), 16 Władysława Reymonta Street, 80-290 Gdańsk, and the Client under the terms and conditions set forth in the Regulations and price list
  3. The person renting the apartment may only be a person over 18 years of age and having full legal capacity.

§2
Agreement lease

  1. The contract concluded between PortJastar and the Client covers only the rental of the apartment . Transportation, meals and organization of the time of stay are the sole responsibility of the Client. Swimming pool, gym and playgrounds are additional attractions not included in the price, but with free use for Marina Jastarnia Apartments customers.
  2. Utilities (gas, electricity, water) are included in the rental price.
  3. In addition to the rental fee for each day of rental of the apartment, a local tax (so called climate tax) is charged in accordance with the current rates.
  4. PortJastar will not charge any additional fees beyond those indicated on the website and in these Regulations. All apartments are furnished and have kitchenettes.

§3
Booking

  1. Reservations can be made by phone at 666-08-08 or by sending an e-mail to: rent@marinajastarnia.pl and in person at the office, on the premises at 13 Ceynowy Street, 84-140 Jastarnia.
  2. Reservation of apartment rental requires payment within 12 hours of its confirmation of 50% of the rental fee for the entire reserved stay, which constitutes a reservation deposit (prepayment). Failure to make this payment will result in automatic cancellation of the reservation.
  3. In addition, in the case of making a reservation by phone, it is obliged to confirm it by e-mail, within 12 hours at the latest.
  4. The price for renting the apartment for the entire period of the client’s stay is fixed, in accordance with the terms of the reservation, and does not change even if the stay is shortened for reasons attributable to the client.
  5. In some cases, the value of the reservation deposit (down payment) may amount to 100% of the apartment rental fee. In particular, PortJastar reserves this possibility in case of booking the last available apartment or in case of a stay of less than 2 days.

To make a reservation, please specify:

  • date of planned arrival and length of stay;
  • the planned time of arrival;
  • the number of persons in the apartment (adults and children, stating their ages of the children);
  • the name of the person making the reservation;
  • telephone number;
  • e-mail address;
  • details for invoice, if required;
  1. Upon receipt of all necessary information, a confirmation of the reservation is sent to the client, along with details for payment of a reservation deposit of 50% of the apartment rental fee for the entire reserved period of stay, subject to paragraph 5 of this section. Payment of this fee is a guarantee of the reservation of the stay. The reservation deposit is non-refundable in accordance with §5 of these regulations.
  2. Payment for the entire rental period of the apartment must not be made later than at the commencement of the rental, unless otherwise specified in the offer or the specific terms and conditions of the reservation communicated to the Client prior to making the reservation.

§4
Booking Guarantee:

  1. Payment of the reservation deposit, in accordance with § 3 of the Regulations, is the sole basis for booking the apartment rental by PortJastar.
  2. Reservations not confirmed by payment of the reservation deposit within 12h, are automatically canceled by the rental reservation system

§5
Cancellation conditions

  1. The booked date and rental period of the apartment is binding for both parties.
  2. In case of shortening the stay by the customer, PortJastar will not refund the money paid.
  3. In case of shortening the lease due to reasons beyond the control of PortJastar, the fees for the unused lease are not refundable.
  4. Once a reservation has been made, it is not possible to change or cancel the reserved apartment rental date.

§6
Price change

The price set at the time of booking is not subject to change, regardless of any circumstances (such as lack of access to the pool, gym and playgrounds)

§7
Price change

  1. In the event that PortJastar, for reasons beyond its control, is unable to perform the rental of the apartment on the date reserved by the Client, it will refund to the Client the entire amount paid as rental fee or, with the consent of the Client, issue a Voucher for the amount corresponding to the amount of the refunded fee.
  2. PortJastar undertakes to provide the Voucher to the Client via e-mail and to accept it for execution only at the PortJastar facility.
  3. The Voucher is non-refundable and non-exchangeable for cash.
  4. The Voucher must be redeemed once and in full.
  5. PortJastar is not responsible for the Voucher that is lost or damaged, after it is given to the Customer.
  6. The Voucher may be ceded to a third party for use by that person at a PortJastar facility. PortJastar is not obliged to cover any possible public law or civil liabilities related to the ceding of the Voucher to the third party. The third party is not entitled to any additional rights over and above those enjoyed by the transferor (Customer) by virtue of the possession of the Voucher. All provisions of these Terms and Conditions, including in particular this paragraph, shall apply to the third party who acquired the Voucher from the Customer. In case of disposal of the Voucher, for its validity, the transferor (Customer) is obliged to inform PortJastar of this fact at least one day before the commencement of rental of the apartment paid for using the Voucher.
  7. When redeeming the Voucher, the Customer is not entitled to receive the rest of the unused amount for which the Voucher is based, when the value of the rental fee is lower than the value of the Voucher.
  8. The Customer is obliged to pay the price difference in cash, payment card or credit card in accordance with the booking rules when the value of the rental fee is higher than the value of the Voucher presented.
  9. The expiration date of the Voucher is shown on the Voucher. However, it cannot be longer than 12 months from the date of issue of the Voucher.
  10. The Customer is obliged to notify PortJastar before making the reservation that the apartment rental fee will be covered by the Voucher.
  11. PortJastar has the right to refuse to redeem the Voucher when:

a) The expiration date of the Voucher has passed,

b) or used by an unauthorized person.
