Regulations of stay in Marina Jastarnia Apartments
§1
General provisions
- The Regulations define the terms and conditions of use and stay in apartments rented from PortJastar Bielawski Spółka Komandytowa (hereinafter referred to as “PortJastar”), 16 Władysława Reymonta Street, 80-290 Gdańsk
- Making an apartment reservation is tantamount to knowing and accepting the provisions of these Regulations
- Definitions:
Facility – a complex of buildings located in Jastarnia at Ceynowy Street, also referred to as “Marina Jastarnia Apartments”, containing apartments owned or operated by PortJastar, as well as other apartments not managed by PortJastar, and the swimming pool, playroom and other parts of these buildings, as well as the playground, gym, parking lot and passageways located next to these buildings, jointly managed by the housing community.
Client – a person renting an apartment owned or operated by PortJastar.
Guest – the Client and persons who stay with the Client in the apartment rented by the Client, in accordance with the apartment reservation made.
Attractions – discounts on water sports, bicycles – subject to availability, animations on selected dates-confirmed by e-mail
§2
Apartment rental period
- The reserved apartment is available to the Client at the earliest from 4:00 p.m. on the first day of the reserved apartment rental period until 10:00 a.m. on the last day of the reserved apartment rental period.
- In the event that the customer does not show up at the property on the day of arrival and pay the entire stay on that day, the reservation is canceled and the deposit remains with the operator.
- Earlier arrival, based on current availability of apartments, is possible only if agreed in advance with the office at 666-08-08-08.
- Late departure: based on current availability of apartments, must be agreed
- Extension of the rental period until 12:00 on the last day of the booked stay – fee of 100 PL
§3
Check-in and key collection policy
- The check-in procedure requires the Client to show a valid photo ID and provide a credit card number and expiration date.
- For the duration of the apartment’s lease, a deposit is collected from the Client, no later than on the day of the Client’s arrival, as security for the entrusted, fully equipped apartment.
- The deposit is collected in cash only.
- The amount of the deposit ranges from 300 to 1000 PLN, depending on the size of the apartment.
- The cash-only deposit is returned after the end of the stay, subject to §8 of these Regulations.
Rates Deposit:
- apartment 1 room (2 persons) – 300zł
- apartment 2-room (3 persons) – 500zł
- apartment 2-room (4 persons) – 500 zł
- apartment 3-room (6 persons) – 700 zł
- 2 level apartments (5-6 persons) – 700 zł, (7- 8 persons) -1000 zł
- PortJastar reserves the right to refuse admission to a Customer who:
• does not have a valid ID card or refuses to show the document,
• refuses to make a cash deposit, or refuses to provide a card number and expiration date as security,
• is under the influence of alcohol or other intoxicants, or other Guests are in such a state,
• has grossly violated these Rules and Regulations or other Rules and Regulations in effect on the premises during the previous stay. - In the event that more Guests arrive at the booked apartment than the number of Guests notified at the time of booking, or in excess of the capacity of the booked apartment, such circumstance will be considered a violation of the Terms and Conditions of Reservation and will result in cancellation of the reservation and forfeiture of previously paid funds by the Client.
- Office opening hours – Marina Jastarnia Apartments, Ceynowy Street, 84-140 Jastarnia: daily from 09:00 – 11:00, 16:00 – 18:00.
- Late arrival, outside office hours, is possible with the approval of a PortJastar employee, after prior telephone contact at 666-08-08-08, made before 16:00 on the day of the planned start of the apartment rental, and is associated with an additional fee , according to the price list below:

- The client, prior to the commencement of the apartment rental, is obliged to perform check-in formalities and collect the keys to the apartment. These activities are carried out during office hours, subject to paragraph 9.
- The keys to the apartment will be issued upon payment for the entire reserved rental period of the apartment, taking into account the previously paid reservation deposit (down payment).
§4
Vehicle parking
- Each apartment is entitled to only one free parking space in an open unguarded parking lot, subject to availability, in an indoor or outdoor plaza. Each additional parking space in the above-mentioned parking lot within one apartment, may be made available upon prior arrangement of availability with PortJastar and payment of a fee of 100 PLN /day.
- Guests are required to park according to the parking card issued at check-in, in the space indicated by the staff.
§5
Securing the facility
- The parking lot is open, not guarded or monitored.
- Security guards, if they are at the Property at the time, do not have custody of and are not responsible for vehicles and other belongings of Guests located on the Property, including apartments.
- PortJastar is not obliged to close the entrance gate to the Property, including at night.
- The exterior lighting of the Facility is turned off during the hours regulated by the apartment community, usually from 11:00 pm.
- Minors are the responsibility of their guardians under whose care they remain throughout their stay at the Facility.
- Recreational parts of the Facility, i.e. the swimming pool, playgrounds, gym, are unguarded and minors may stay there only under the supervision of adult guardians.
- PortJastar is not responsible for property left on the premises of the Facility, including the apartment, therefore Guests should not leave valuables unattended.
§6
Check out and return of keys
- Handing over the key at the end of the rental period takes place in the office of Marina Jastarnia Apartments on the day of departure between 9:00 and 10:00 am.
- The apartments are inspected by the building’s staff after departure. In case of any defects, damages or losses in the apartment’s equipment, the guests will be charged for the damages or losses in the equipment.
- Guests who intentionally or accidentally destroy property located in the Property are obliged to repair the damage on general principles, in accordance with the Civil Code.
- Any claims for possible damage verified at the reception of the apartment by the staff will be pursued through the courts, if it is not possible to enforce them amicably.
- In case of loss of keys, magnetic card (so called “watch”) to the Facility, the Client is obliged to pay a fee of 200 PLN.
§7
Silence night
- Guests are required to observe the rules of good neighborliness, and in particular to observe the quiet hours of the night from 10 pm to 6 am.
- In the event of a reported disturbance of the peace PortJastar has the right to impose a fine of 500 PLN added to the Client’s bill, regardless of whether the disturbance was committed by the Client or the Guests staying with him.
§8
Responsibility for the apartment
- PortJastar reserves the right to collect a deposit in cash only, for which an appropriate receipt is issued and given to the customer in the amount of 300-1000 PLN, in accordance with §3 of these Regulations, as security for possible claims for damages during the stay.
- Damage amounts are valued on the basis of current prices of products and services (may be determined on the basis of prices shown on the Internet at the time).
- An approximate price list is available at the reception of the facility.
- The deposit is refunded to the Client on the day of departure in full in cash only after handing over the deposit return receipt, if no damage has been caused in the apartment or in the Facility, otherwise the deposit is refunded after deducting the costs necessary to remove the damage caused.
- The Client is responsible for all damages caused by Guests staying in the rented apartment.
§9
Conditions of use of the apartment
- Guests are required to dispose of garbage before leaving the apartment, as this activity is not included in the final cleaning of the apartment.
- Whenever leaving the apartment, Guests are required to close all windows and lock the exit door on all locks to which they have received keys.
- Guests are required to pay special attention to the proper operation of water valves and electrical appliances.
- For reasons of fire protection, Guests are not allowed to use any electric-powered devices that do not constitute equipment of the apartment except: chargers for cell phones, laptops and other mobile devices, shaving razors, hair dryers.
- Personal belongings left in the apartment by Guests ending their stay will be sent back at the expense of the Client by courier, to the address indicated. In the absence of disposition, PortJastar will store the items for a period of 7 days and then dispose of them or donate them to charity.
- Guests are required to maintain the apartment in the condition it was in at the beginning of their stay.
§10
Smoking ban
- Smoking is strictly prohibited in the apartment.
- Violation of this prohibition is subject to a fine of 500 PLN, added to the Client’s bill¸ regardless of whether the prohibition was violated by the Client or the Guests staying with him.
§11
Price change
PortJastar shall not be obliged to reduce the rental fee for an already booked apartment, even if, during the period for which the Customer has booked the apartment, PortJastar offers to rent similar apartments at a lower price than the price that was indicated to the Customer during his reservation.
§12
Pets
- Guests are not allowed to keep pets in the apartments without prior approval of PortJastar.
- In the case of prior approval to keep a pet in the apartment, the client is required to pay an additional fee of 200 PLN for the entire period of apartment rental.
§14
Emergency Situations / Force Majeure
- In the event of unforeseeable circumstances, the consequences of which cannot be immediately eliminated by customary means, PortJastar, reserves the right to offer the Client a replacement apartment, to change the booking date, to change an object of similar standard, or to cancel the booking (only if Portjastar is unable to make a change within the booking date or provide an object of similar standard). This also applies to cases in which the personal safety of Guests or their property, for reasons beyond PortJastar’s control, cannot be guaranteed. Amounts paid by the Client are subject to immediate refund, with deduction of amounts due for services already rendered, if other solutions do not take effect (rescheduling of the reservation, substitute apartment or change of facility of similar standard).
- In case of cancellation of the reservation by PortJastar, for reasons beyond its control “e.g. Covid 19 at the facility”, PortJastar undertakes to refund the reservation deposit (prepayment), but is not obliged to pay any penalties, damages, etc.
- Please be advised that making a reservation or staying in Building “C” with a swimming pool, involves discomfort type noise (noise of children coming from the pool and indoor playground, operation of pool pumps, etc.). Any complaints and complaints will not be the basis for cancellation of the reservation or reduction of the apartment rental period and refund of the apartment rental fee paid. The rental fee for apartments in Building “C” includes a discount for reduced comfort of stay for reasons described in this section.
§15
Breakdowns
- PortJastar undertakes to repair any malfunctions arising in the apartment up to 72h, unless the nature of the malfunction requires a longer repair time.
- Malfunctions arising for reasons beyond PortJastar’s control, (supply of utilities, including TV and Internet, furnace malfunctions, equipment malfunctions in the apartment), lack of access to the gym, swimming pool, playgrounds or lack of attractions do not constitute grounds for cancellation of the reservation or rental of the apartment and thus is not a basis for reduction or refund of the rental fee or reservation deposit (deposit).
§16
Dispute resolution
- The law applicable to disputes between PortJastar and the Client or Guest is Polish law.
- Disputes will be settled by the court having jurisdiction over PortJastar’s registered office.
§17
Final provisions
- The number of Guests in the apartment must not exceed the number specified in the booking confirmation. If this number is exceeded, the company has the right to charge a fee for each additional person in the amount of 150 PLN or terminate the apartment rental agreement with immediate effect without refunding the reservation deposit paid.
- All additional services/products offered in the facility are charged extra.
- PortJastar does not provide daily cleaning services of the apartments, change of bed linen and towels, and does not equip the apartments with any additional equipment other than what is in the apartment at the time it is released to the Client.
- Persons who are not Guests, as defined herein, are not allowed to enter the premises, including the swimming pool, indoor playground, indoor playground, gym, etc.
